  • 4th Cir.- Abuse of Discretion in Rendering Benefits Decisions

In a very brief opinion from the Fourth Circuit, the Court of Appeals found that Unum did not act unreasonably in terminating the Appellant's LTD benefit's after a decade. The court held that:

Having had the benefit of oral argument and having carefully considered the briefs, the record, and the applicable authorities, we are satisfied that First Unum did not abuse its discretion in rendering its benefits decision against Stoddard.
    The unpublished opinion is attached.
